7.Renewed Change-of-Venue Motion and Ruling
4 linesBOYD YOUNG: Your Honor, I believe I had told the Court that after the jury was struck I would need to renew my motion for change of venue.
THE COURT: Yes, sir.
BOYD YOUNG: I believe that five of the first twelve jurors were jurors that stood up on Monday and exposed to pretrial publicity and one of the alternate's. So based on the overwhelming amount of publicity and the fact that had a jury voir dire, I think that the fact that five of those jurors in for the twelve would deprive Mr. Jones the right to a fair trial and we would, again, ask the Court to consider a change of venue.
THE COURT: Okay. I think we have taken an abundance of to try to minimize pretrial publicity information out there and so respectfully I am going to deny your motion for change of venue on that fashion. Let's stand at ease and bring the jury up here, please. Let's take a few minutes because I don't think the elevator can hold everybody. (Whereupon, the jury comes into the courtroom at approximately 10:40 a.m.)
