JANICE ROSS, being first duly sworn, testified as follows:

COURT CLERK: Have a seat, Doctor. Once you're seated, state your full name, spelling your last on the record, please.

34:20:12

JANICE ROSS: Janice Edward Ross, R-O-S-S.

DIRECT EXAMINATION BY MR. HUBBARD:

54:20:18

MR. HUBBARD: Dr. Ross, you've testified earlier on this matter and I want to revisit the autopsies you performed on September 11th, 2014. I'd like to begin, did you document the autopsy process and the initial -- your initial process when you found -- or received the bodies of these children? Did you photograph the condition the bodies were in?

64:20:44

JANICE ROSS: Yes, I did.

74:20:45

MR. HUBBARD: If I may, Your Honor.

84:20:48

THE COURT: You may. I forgot, Dr. Ross, I remind you you're under oath.

94:20:55

MR. HUBBARD: She just got sworn again, so she's double sworn.

104:21:03

MR. HUBBARD: I want to show you what's been previously marked State's ID 212 as to -- came in as bag number one, we now know Elias Jones. I'm going to show you two photographs and see if you can identify these -- or three photographs, 212A, B and C.

114:21:20

JANICE ROSS: Yes. Those are photographs of who we found out was Elias Jones when they entered the morgue.

124:21:29

MR. HUBBARD: All right. As to 212A, does that photo depict the way the bag appeared when it was on the autopsy table as it was received by you?

134:21:40

JANICE ROSS: Yes. It was torn.

144:21:42

MR. HUBBARD: And you see animal activity in that torn portion?

154:21:47

JANICE ROSS: Yes, one of the limbs, I think it was the arm, had some tissue loss.

164:21:55

MR. HUBBARD: 212B, State's ID, do you see clothing or a shirt worn by Elias at that time?

174:22:03

JANICE ROSS: Yes. It has a logo for the elementary school Saxe Gotha.

184:22:07

MR. HUBBARD: It says, The Power of One at Saxe Gotha Elementary?

194:22:11
204:22:12

MR. HUBBARD: And that's how he was clothed when he arrived?

214:22:15
224:22:15

MR. HUBBARD: And C, which is 212C for ID, is that the full body with the clothing?

234:22:24
244:22:25

MR. HUBBARD: And does it show the left arm with animal activity?

254:22:30
264:22:30

MR. HUBBARD: Your Honor, I move these into evidence.

274:22:37

MR. YOUNG: Subject to previous objection.

284:22:40

THE COURT: Subject to objection.

(WHEREUPON, State's Exhibit numbers 212, 212A, 212B, and 212C were admitted into evidence.)

(Whereupon, State's Exhibits 212D through 212I were marked for identification only.)

314:23:09

MR. HUBBARD: We move to bag two, came into you as bag two, we now know is Merah Jones?

324:23:14
334:23:17

MR. HUBBARD: I show you what's been marked as State's ID 213. And I believe you've initialed each outer bag that I've got these in?

344:23:23
354:23:25

MR. HUBBARD: Okay. I've got two photos, 213A and 213B. Do you recognize these?

364:23:33
374:23:34

MR. HUBBARD: 213A, does that show who we now know is Merah Jones as she was received once you pulled her out of the bag?

384:23:41

JANICE ROSS: Yes. She was in a sleeping bag, which had -- was blue, but had different balls portrayed on it.

394:23:53

MR. HUBBARD: So it was some type of boy's bedding?

404:23:56

JANICE ROSS: It appeared to be, yes.

414:24:01

MR. HUBBARD: 213B for State's ID, does that show the decomp and animal activity as to her left arm and the missing arm?

424:24:08
434:24:09

MR. HUBBARD: When you got the bedding off of her, did she have any clothing on her?

444:24:16
454:24:17

MR. HUBBARD: And that's how she appeared when you got her?

464:24:19

JANICE ROSS: Correct.

474:24:21

MR. HUBBARD: Your Honor, I offer these into evidence.

484:24:29

THE COURT: Subject to the objection.

(WHEREUPON, State's 213, 213A and 213B were admitted into evidence.)

504:24:48

MR. HUBBARD: I'm going to show you what came to you as bag three, we now know is Gabriel Jones, 214 State's ID. And you've initialed this gold envelope as well?

514:25:02
524:25:03

MR. HUBBARD: I'm going to show you photo A, B, C, D, E and G. And 214A, is that how Gabriel Jones presented when you got him out of the bag?

534:25:21
544:25:22

MR. HUBBARD: Can you describe his position in that particular photo?

554:25:24

JANICE ROSS: He is face down with his knees underneath him, but the right leg we noted had been disarticulated at the knee, so the foot was coming the opposite direction as normal.

564:25:44

MR. HUBBARD: And would that be because of him being in a bag as if he's stuffed in a bag?

574:25:53

JANICE ROSS: Most likely, yes.

584:25:54

MR. HUBBARD: Now, looking at 214B ID, is that a shirt?

594:25:59

JANICE ROSS: Yes, that was in the bag with him. It looked like an adult-sized shirt.

604:26:08

MR. HUBBARD: Is that the Three Fountains Chiropractic shirt, adult large?

614:26:13
624:26:16

MR. HUBBARD: 214C for ID, is that a slipper, a girl's slipper in that bag?

634:26:20
644:26:21

MR. HUBBARD: Now, Gabriel is a boy, but this is a girl's slipper?

654:26:23

JANICE ROSS: Correct.

664:26:25

MR. HUBBARD: 214D for ID, is that a Hello Kitty journal?

674:26:29
684:26:30

MR. HUBBARD: That was in Gabriel's bag as well?

694:26:32
704:26:35

MR. HUBBARD: 214E, is that a diaper that was in that same bag?

714:26:39
724:26:40

MR. HUBBARD: And then finally, 214G for ID, is this the close-up of Gabriel's neck showing the ligature marks that you described earlier in your testimony.

734:26:53
744:26:54

MR. HUBBARD: Your Honor, I move all these into evidence.

754:27:02

THE COURT: Subject to the objection.

(WHEREUPON, State's Exhibit numbers 214, 214A, 214B, 214C, 214D, 214E, 214G were admitted into evidence.)

(Whereupon, State's Exhibit 214F and 214H were marked for identification only.)

784:27:36

MR. HUBBARD: Dr. Ross, I want to move on to bag four, which was Abigail Jones, State's ID 215. You've initialed this gold envelope as well?

794:27:48
804:27:49

MR. HUBBARD: I'll show you two photos, A and B. Is 215A for ID, is that how Abigail appeared when you pulled her out of the bag?

814:28:01
824:28:02

MR. HUBBARD: How does she present in this photo?

834:28:04

JANICE ROSS: She's wrapped in a couple of sheets.

844:28:07

MR. HUBBARD: Her body is pretty much hidden there?

854:28:09
864:28:12

MR. HUBBARD: 215B, is that when you unwrap her?

874:28:15
884:28:16

MR. HUBBARD: What is she wearing?

894:28:20

JANICE ROSS: She is --

MR. HUBBARD: Is that a portion of a diaper?

914:28:23

JANICE ROSS: Yes, it's a little bit of a diaper.

924:28:25

MR. HUBBARD: Just a portion of one?

934:28:26
944:28:28

MR. HUBBARD: Your Honor, I move these into evidence.

954:28:32

THE COURT: Subject to objection.

(WHEREUPON, State's Exhibit numbers 215, 215A and 215B were admitted into evidence.)

974:28:49

MR. HUBBARD: Finally, Dr. Ross, I want to move on to bag five, which we now know is Nahtahn, State's ID 216. And you've initialed this gold envelope as well?

984:29:01
994:29:02

MR. HUBBARD: I've got three photos, 216A, B and C. And 216A, is that how Nahtahn presented when you pulled him out of the bag?

1004:29:17
1014:29:18

MR. HUBBARD: And what is that wrapped around him?

1024:29:20

JANICE ROSS: A comforter that had Ninja Turtles depicted on it.

1034:29:28

MR. HUBBARD: 216B, is that when you removed the comforter?

1044:29:31
1054:29:32

MR. HUBBARD: What, if anything, is he wearing?

1064:29:33

JANICE ROSS: Nothing.

1074:29:37

MR. HUBBARD: And then 216C, is that the elbow that you described in your previous testimony?

1084:29:43
1094:29:43

MR. HUBBARD: With the injury on that elbow?

1104:29:45
1114:29:46

MR. HUBBARD: Were you able to determine if that was pre or post-mortem?

1124:29:49
1134:29:50

MR. HUBBARD: Okay. But you did note it because it was an injury?

1144:29:52

JANICE ROSS: Correct.

1154:29:53

MR. HUBBARD: And the bag, had it been torn into?

1164:29:56

JANICE ROSS: No, it had not.

1174:29:58

MR. HUBBARD: Your Honor, I move these into evidence.

1214:30:32

THE COURT: Yes, sir.

1224:30:36

MR. HUBBARD: Dr. Ross, I do have a few other things I'd like you to look at. State's ID 337, 336, 335, 334, and 333. What are these?

1234:31:00

JANICE ROSS: Those are copies of the official certified death certificates on these five children.

1244:31:07

MR. HUBBARD: Your Honor, I move these into evidence.

1254:31:10

MR. YOUNG: No objection.

1264:31:11

THE COURT: No objection. Do the certificates have the names of the children on each one of them respectfully?

1274:31:20

1434:32:32

JANICE ROSS: Yes, the hyoid bone was fractured.

1444:32:35

MR. HUBBARD: As to State's 334, it says Merah Gracie Jones?
