21 linesSHAWN GRAHAM: Your Honor, at this time, the State is going to introduce and publish Mr. Jones' convictions from Illinois.
THE COURT: All right.
SHAWN GRAHAM: I have several Court Exhibits that have been premarked and I'll put those in now for the record. That's 114, 115, 116 and 117 as Court's Exhibits.
THE COURT: Those are the records from the State of Illinois admitted. (WHEREUPON, Court's Exhibit numbers 114 through 117 were marked for identification.)
SHAWN GRAHAM: I have one, two -- I have five certified convictions, Your Honor, that have been premarked. 295, Your Honor, is a conviction from McHenry County Clerk of Circuit Court. We would move that into evidence and publish. It would be 295, 292, 293, 291 and 294. Those are all currently marked as State's ID and we move all of those into evidence at this time.
ROBERT MADSEN: No objection.
THE COURT: No objection to those five. 291, 292, 293, 294, 295 are admitted, which are prior convictions from the State of Illinois. (WHEREUPON, State's Exhibits 291, 292, 293, 294, 295 were admitted into evidence.)
SHAWN GRAHAM: Permission to publish, Your Honor?
THE COURT: Sure.
SHAWN GRAHAM: 295 is a conviction for possession of cocaine. The offense date was March 30th of 2001. The disposition date was March 14th of 2002, a one-year sentence. State's 292 is a conviction for burglary, an offense date of September 3rd of 2001, a conviction date of March 14th of 2002, a sentence of six years with restitution and boot camp. 293, a conviction for forgery, an offense date of September 13th of 2001, a conviction date of March 14th of 2002, a fine, five-year sentence in the Department of Corrections and boot camp. 291, a conviction for receiving or possession of a stolen vehicle, an offense date of September 15th of 2001, a conviction date of March 14th of 2002, a six-year sentence and boot camp. 294, a conviction for theft, an offense date of September 15th of 2001, a disposition date of March 14th of 2002, a sentence of six years and boot camp.
BOYD YOUNG: Your Honor, may we approach real quick?
THE COURT: You may. (Whereupon, a bench conference was held in the presence of the jury but out of the hearing of the jury.)
THE COURT: Solicitor, read the indictment so it's clear as to the nature of the offenses. The reason I'm doing this, Illinois may define something different than South Carolina does. It's somewhat confusing. So the indictment can outline the subject matter with a little more detail so you can understand what it exactly did.
SHAWN GRAHAM: For all the indictments or just the one, Your Honor.
THE COURT: Just the one.
SHAWN GRAHAM: Just that one?
THE COURT: Uh-huh.
SHAWN GRAHAM: State's 292 was a conviction for burglary. The indictment reads that on or about September 3rd, 2001, in McHenry County, State of Illinois, Timothy R. Jones committed the offense of burglary in that the said Defendant without authority knowingly entered a 1987 Dodge automobile bearing Illinois registration number J565521 located at 197 Northwest Highway, Carey, McHenry County, Illinois with the intent to commit therein a theft.
THE COURT: All right.
