COURT CLERK: Have a seat over here, please. State your name, spelling your last for the record.
MARTY LONGSHORE: Marty Longshore, L-o-n-g-s-h-o-r-e.
DIRECT EXAMINATION By Ms. Mayes:
SUZANNE MAYES: Tell us a little bit about yourself, Investigator Longshore. Where are you currently employed?
MARTY LONGSHORE: Currently employed with the Attorney General's Office in Columbia.
SUZANNE MAYES: The South Carolina Office of the Attorney General?
MARTY LONGSHORE: Yes, ma'am.
SUZANNE MAYES: Prior to that where were you employed?
MARTY LONGSHORE: Lexington County Sheriff's Department.
SUZANNE MAYES: And were you involved in the investigation of State versus Timothy Ray Jones, Jr. in regards to researching some of the receipts in this case?
MARTY LONGSHORE: Yes, ma'am.
SUZANNE MAYES: Particular some of the receipts that had come from the vehicle of Timothy Ray Jones, Jr.?
MARTY LONGSHORE: Yes, ma'am.
SUZANNE MAYES: I'm going to ask you whether or not you are familiar with a Dollar General receipt.
MARTY LONGSHORE: Yes, ma'am.
SUZANNE MAYES: What action, if any, did you take after you were made aware of that Dollar General receipt?
MARTY LONGSHORE: I went to the location of the Dollar General and purchased several items that matched the receipt.
SUZANNE MAYES: I'm going to show you what is not premarked. I'm going to ask you whether or not you recognize it. Having viewed that Dollar General receipt that came from the vehicle of Timothy Ray Jones, Jr. were you able to go back to Dollar General and make duplicate purchases?
MARTY LONGSHORE: Yes, ma'am.
SUZANNE MAYES: And can you tell us whether or not a receipt was generated for that transaction?
MARTY LONGSHORE: Yes, ma'am.
SUZANNE MAYES: Can you tell us whether or not any large trash drawstring bags were part of that duplicate purchase?
MARTY LONGSHORE: Yes, ma'am. They were.
SUZANNE MAYES: And can you tell us whether or not any sunglasses were also part of that duplicate purchase?
MARTY LONGSHORE: They were.
SUZANNE MAYES: You were able to find both of those items?
MARTY LONGSHORE: Yes, ma'am.
SUZANNE MAYES: When you were at Dollar General?
MARTY LONGSHORE: Yes, ma'am.
SUZANNE MAYES: This would be the items?
MARTY LONGSHORE: Yes, ma'am. They are.
SUZANNE MAYES: That would be State's 143, Your Honor. A joint item.
THE COURT: No objection?
ROBERT MADSEN: No objection.
THE COURT: No objection. (Whereupon, State's Exhibit number 143 was admitted into evidence.)
SUZANNE MAYES: Nothing further at this time, Your Honor.
THE COURT: Mr. Madsen?
ROBERT MADSEN: Mr. Longshore, how are you?
MARTY LONGSHORE: Good. How are you?
ROBERT MADSEN: No questions.
RICK HUBBARD: Your Honor, at this time would be a good time to take a lunch break. The next witness will be long.
THE COURT: That will be fine. All right. Don't talk about the case. Enjoy your lunch. See you back at 1:30 thereabouts. If y'all are late we will wait on you. (Whereupon, the jury was excused from open court for a lunch break.)

THE COURT: All right, when you sit down Mr. Young will say something on the record.
BOYD YOUNG: Your Honor, it is my understanding that the State intends to call Special Agent Mackey to the stand, he is the FBI Agent who, along with Detective Creech, conducted the interview of Mr. Jones on the--
THE COURT: On the Monday?
BOYD YOUNG: Yes, sir. And subject to the Court's previous rulings, I just want to put on the record that I would be intending to ask him questions about whether or not he was aware about the prior rights invocations as, when the State talks about Tim Jones voluntarily agreeing to talk to them. Based on the Court's ruling, my understanding is I am ordered not to ask those questions and I will abide by that ruling. I want to put my objection on the record now rather than interrupting or having to send anybody out.
THE COURT: And the proffer would be similar to the one done for Eric Johnson as well as the Sheriff.
BOYD YOUNG: Right, he didn't know, yes.
THE COURT: He didn't know but Johnson says he was not aware, wasn't told.
BOYD YOUNG: Right.
THE COURT: Those same facts will carry over for Mackey, it is just a different interview.
BOYD YOUNG: Yes, sir.
THE COURT: Okay. So you are protected on that issue, that question will not be allowed to ask, is there anything about the waiver or invocation of rights from the Saturday night ten minute interview. Now, I don't suppose you are going to ask him anything about the waiver or not on the 7th.
BOYD YOUNG: We can do it with Mackey. Maybe we can just, do you want to do it real quick or--
THE COURT: If y'all are going to have to do it let's do it before they come in because if that, it will be easier to do.
BOYD YOUNG: Mr. Mackey.
